How Do the California Board of Vocational Nursing and Psychiatric Technicians Discipline Proceedings Work?
Per the Business and Professions Code, the Board of Vocational Nurses and Psychiatric Technicians must follow the Complaint Prioritization and Referral Guidelines.
The guidelines separate complaints into categories to help determine who conducts the investigation. All category one and two complaints, which are the most difficult and egregious cases, are sent to the Department of Consumer Affairs Division of Investigations.
The BVNPT retains all other cases and conducts the investigations using the following methods:
- The complaint is received and assigned to the appropriate investigator, based on its severity/category.
- The complaint is fully investigated.
- If it is determined there is no jurisdiction, insufficient evidence, or no violation, the investigation will be closed.
- If the investigation determines there is no need for formal discipline, the BVNPT may notify the Vocational Nurse or Psychiatric Technician of a citation or fine, letter of reprimand, cease and desist order, notice of warning, violation letter, or letter of admonishment.
If the case is referred to the District Attorney’s office, and a formal Accusation is filed against the Vocational Nurse or Psychiatric Technician, the result could be:
- License suspension, revocation, or surrender
- Probation
- Dismissal
